Article 142 — Overbid by Creditors

1/ Where the price is insufficient to meet the claims of creditors having a claim secured by the business and creditors having made an application under Sub- Article (1) of Article 141 the creditors may move the court to order that the business be sold by auction. 2/ The court shall order the sale by auction and the price of the sale shall be higher by one tenth than the price specified in the contract of sale. 3/ Where no third party presents himself at the sale, the business shall be sold to the creditor making the highest bid.
