Article 94 — Issue of summons

(1) When a suit has been duly instituted, a summons shall, unless otherwise provided, be issued to the defendant to appear and answer the claim on a day to be specified therein in accordanre with Art. 233 or 338 : Provided that no such summons shall be issued when the defen- d~nt has appeard at the presentation of the statement of claim and admitted the plaintiffs claim. (2). The summons shall order the defendant to produce all the docu- ments mentioned in the list annexed to the statement of defence under Art. 223 (3). Every summons shall be in the form prescribed by the Second Schedule to this Code and shall be signed by a judge or the regis- trar and sealed with the seal of the court.
