Article 335 — Conditions for ordering stay

(1) No order for stay of execution shall be made under Arts. 332 -334 unless the court or President making it is satisfied: (a) that substantial loss may result to the party applying for stay of execution unless the order is made; (b) that the application has been made without unreasonable delay; and (c) that money has been deposited. security given or a surety produced by the applicant for the due performance of such decree or order as may ultimately be binding upon him. (2) The application shall be deci~ed after the parties have been heard: Provided that the court may, on an application supported I¥ CIVIL PROCEDURE CODE 109 affidavit, make an ex parte order for stay of execution pending the hearing of such application.
