Article 329 — New facts and arguments

(1) Subject to the provisions of Art. 345 the appellant may not raise any fact which was not in evidence in the court which gave the judgment appealed from. (2) The Appellate Court may allow amendment ofthe memorand1Di. of appeal and arguments upon such terms of service of notice, costs or otherwise as it may think fit.
