(1) An Appellate Court may in its discretion, either before the respon- dent is called upon to appear and answer or afterwards on the application of the respondent, require from the appellant security for the costs of the appeal, or of the original suit, or of both.
(1) An order under sub-art.
(1) shall be made where the appellant is residing °1!!--of Ethiopia and is not possessed of any sufficient immovable property within Ethiopia other than the property, if any, to which the appeal relates. .
(3) Where such security is not furnished within such time as the court orders, the court shall dismisss the appeal and the provisions of Art. 101
(2) shall apply by analogy. PARAGRAPH
3. AFFIDAVITS Art. 103- Power to order any point to be proved by affidavit
(1) The court may at any time for sufficient reason order that any particular fact or facts be proved by affidavit, or that the affidavit of any witness be read at the hearing, on such conditions as it thinks reasonable.
(1) Where it appears to the court that either party bona fide desires the production of a witness for cross-examination, and that such witness can be produced, no order under sub-art.
(1) shall be made.
