Article 236 — Particulars of set- off

(l) Where in a suit for the recovery of money the defendant claims to set-off against the plaintiffs demand any ascertained sum of money legally recoverable by him from the plaintiff, not excee- ding the pecuniary limits of the jurisdiction of the court, and both parties fill the same character as they fill in the plaintiffs suit, the defendant shall in his statement of devence give the parti- culars as to the debt sought to be set-off.
(2) The statement of defence shall have the same etTect as a state- ment of claim in aross-suit so as to enable the court to give a final judgment with respect both to the original claim and to the set-off.
