Article 385 — Procedure on receiving application for execution

(1) On receiving an application for execution the court shall ascer- tain whether such of the requirements of the preceding Articles as may be applicable to the case have been complied with and may, if they have not been complied with, reject the application or al- low the defect to be remedied on such terms as it shall ~~. (2) Where an application is amendea under sub-art. (I), it shall be deemed to have been an application in accordance with law and presented on the day when it was first presented. (3) Every amendment made under sub-art. (I) shall be dated and signed or initialled by th, presiding judge.
