Article 113 — Atlditi01U1lpayment

(1) Where it appears to the court that the sum paid into court is not sufficient to cover such expenses or reasonable remuneration, the court may direct such further sum to be paid to the witness as appears to be necessary on that account. (2) Where a witness must be detained for more than one day, the court may orcier the party at whose instance he was summoned to. pay into court such sum as is sufficient to defray the expenses of his detention for such further period. (3) In case of default in payment under this Article, the court may either order such sum to be levied by attachment and ~le of the moorable prooertv of the party obtaining the summons or dischar- ge the person summoned without requiring him to give evidence or may order both such levy and discharge.
