Notwithstanding the provisions of this Code regarding the appointment of
guardian or tutor, the following persons shall not be bound to take up the
functions of guardian or tutor, upon a mere declaration on their part, except as
regards their own children:
(a) any person who has completed his sixty-fifth year;
(b) soldiers in active service.
