Article 48 — ~Stay.of proceedings in private prosecution pending institution of proceedings

by public prosecutor. Where the evidence in a private prosecution discloses that a more serious of- fence has resulted than has been charged in a private prosecution, the p~blic prosecutor may apply to the court to stay the proceedings pending the institu- tion of fresh proceedings by the public prosecutor.and the court shall thereon stay the proceedings.
