Article 115 — Person charged IiUthan offence may be convicted of an attempt or as ac-

cessory or instigator. (1) Where the accused is charged with an offence, he may be convicted of hav- ing attempted to commit the offence although the attempt is not separately charged. (2) Where an accused is charged with an offence as principal, he may be con. victed as an instigator or as an accessory, although he was not charged as such.
