Article 221 — Costs of private prosecution.

(I) The costs of a private pros~ution shaIl be borne by the private prosecutor in accordance with Art. 46
(2) Where in a private prosecution the accused is acquitted and the court is of opinion that the charge was not made in good faith, it may order the private prosecutor to pay the whole or any part of the costs incurred by the accused.
(3) Where a private prosecution is stayed as provided in Art. 48, all the costs of the private prosecution shaIl be borne by the government.
